D’s Shop is operated by Cressoft Technology Inc., a Canadian corporation with its principal place of business at Unit 36 – 5055 Heatherleigh Avenue, Mississauga, Ontario L5V 2R6, Canada (“we”, “our”, “us”). By using this website you agree to these terms. If you do not agree, please do not use the site.

1. Eligibility

You must be of the age of majority in your province or territory (18 in Ontario) to place an order. By ordering you confirm you meet that requirement.

2. Products and Pricing

All prices are listed in Canadian dollars (CAD). Applicable GST/HST/PST is calculated at checkout based on your shipping address. We strive for pricing accuracy but reserve the right to correct obvious errors. If a pricing error affects your order we will contact you before charging and you may cancel for a full refund.

3. Promotional and Compare-At Prices

When we show a reference (“compare-at”) price along with a sale price, the reference price reflects the manufacturer’s suggested retail price or the price we charged for a meaningful period before the promotion, in line with the Competition Bureau’s guidance on ordinary price claims.

4. Orders

Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion, including for stock, pricing-error, or fraud-prevention reasons. If we decline, we will issue a full refund within 5 to 10 business days.

5. Shipping and Fulfilment

We deliver to Canadian addresses. Most products ship from our global supplier network (see our Shipping Policy for details and typical delivery windows). Delivery times are estimates and not guaranteed. Risk of loss passes on delivery.

6. Returns and Refunds

Returns are subject to our Returns Policy, which gives you 30 days from delivery to request a return. This does not affect your statutory rights under your province’s consumer protection legislation (including the right to cancel certain “Internet agreements” under Ontario’s Consumer Protection Act, 2002).

7. Account and Acceptable Use

You are responsible for the accuracy of the information you provide and for safeguarding your account password. You may not use the site for unlawful purposes, to introduce malware, or in a way that disrupts the experience of other customers.

8. Intellectual Property

All site content, including logos, design elements, and editorial copy, is owned by Cressoft Technology Inc. or licensed from its suppliers. Product imagery and descriptions remain the property of the original supplier where applicable. You may not reproduce, adapt, or distribute any of this content without our written permission.

9. Disclaimers

Products are sold “as is” subject to the manufacturer’s warranty (if any) and your statutory rights. We make no additional warranties express or implied except as required by law.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or relating to your use of the site or any order is limited to the amount you paid for the relevant order. We are not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these terms excludes or limits liability for fraud, wilful misconduct, or anything else that cannot be excluded by applicable Canadian law.

11. Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control, including supplier disruption, customs holds, carrier delays, severe weather, labour action, outages, or government orders.

12. Governing Law and Disputes

These terms are governed by the laws of Ontario, Canada and the federal laws of Canada applicable in Ontario. The courts of Ontario have exclusive jurisdiction over any dispute, except that you may bring claims in the small-claims court of your province of residence where the law permits.

13. Changes

We may revise these terms. The version in effect when you place an order applies to that order. Continued use of the site after a change means you accept the new terms.

14. Severability

If any provision of these terms is held invalid, the remaining provisions remain in full effect.
